流行音乐,是社会发展的产物,流行音乐不仅是一种音乐形式,同时也创造
了大量的经济效益和社会价值。同时,做为音乐创新的基础,著作权保护工作也
成为了目前的一个社会问题,引起了很多的关注。
我国对保护著作权在内的知识产权工作极为重视,相继颁布和参加了许多著
作权保护法律、国际公约,初步建立了较完善的著作权保护制度。但由于我还比较低下,还没有建立完善的社会主义法制环境,因此侵犯音乐著
作权的问题屡有发生,打击了音乐创新的积极性,损害了我国的国际形象,妨碍
了音乐产业的发展。探索出一条有中国特色的社会主义音乐著作权保护之路是保
障文化产业健康发展的基础。
本论文将从流行音乐与著作权保护两方面下手,系统地梳理流行音乐著作权
保护的现状,分析流行音乐著作权的理论特点,并提出改善中的初步设想。
中国音乐著作权保护刚刚起步,任重道远,希望可以以自己几年的研究心得,
从著作权法的角度来阐述这个问题,使之能够促进中国音乐文化产业的发展,实
现音乐创新与著作权保护的双赢。

Abstract

Abstract
Pop Music as the offspring of the development of society , is not only a form of
music , but also creating much economic benefit and the value of society .At the same
time , copyright protection leads to great attention as a social problem in nowadays.
Our country pay great attention to the intellectual property include of copyright
protection . It issued many laws of copyright protection and attended many
international convention one after another . They set up a perfecter system of
copyright protection preliminary .But because of our productivity is a little lower and
we didn’t set up a perfect situation of law in society . So it’s often to see the problem
of infringing a musical copyright , attacked the initiative of bring forth new ideas of
music , damaged the international image of our country , interfered the development
of the cultural industry . So it’s more important to explore a new road in protecting
musical copyright in Chinese characteristic socialism .
The essay includes two parts , pop music and musical copyright protection . It’ll
put in order the status of copyright protection of pop music, analyse its theory
characteristic and put forward imagining a harmonious road in protecting musical
copyright .
