少数民族受教育权法律保障研究Study on Legal Protection for Minority Education Right聂武莲内容摘要近年来,我国法学界对少数民族受教育权问题的研究逐渐得到重视。从总体上看,对保障少数民族受教育权的研究已从个案发展到一般,但少数民族受教育权的一般理论研究还比较滞后,在立法上规定简单,没有形成体系,如何实现和保障少数民族受教育权,使少数民族受教育权从法定权利转变为现实权利是急待解决的问题。因此,本文在分析少数民族受教育权的一般理论问题基础上,对少数民族受教育权法律保障进行研究,以期有所裨益。本文首先从本体论的角度明确少数民族受教育权的概念、性质、法律关系的基本要素和保障少数民族受教育权的价值目标定位。少数民族受教育权是一项基本人权,既在本质上是宪法权利,同时还是被教育法、民族区域自治法具体化的法律权利,由受教育平等权和受教育自治权两种权利及其子权利构成。接着文章主要对这些具体少数民族受教育权的立法和实施情况进行实证分析,建国以来我国制定了大量的关于少数民族教育经费筹集、师资培养、民族文化传承、双语教学、办学形式、升学优待等特殊的少数民族受教育权,但由于其立法的高度原则性和概括性削弱了规范的可操作性,以及受教育权司法救济制度的不完备,这些权利在实施过程中仍显示出局限性,平等权和自治权都缺乏有效保障。文章最后从立法和行政两方面讨论了少数民族受教育权保障体系的构建,重点提出了少数民族受教育权的法律体系的完备、内容的完善、法律责任的明确等建议。关键词:少数民族受教育权法律保障AbstractThe minority education right is gradually taken seriously by Chinese law experts.
