中文摘要本文对受贿罪的研究,主要包括我国古代及其他国家受贿罪情况、受贿罪的犯罪构成、受贿罪的共同犯罪问题,并立足于刑事司法实践,对受贿罪的刑罚完善提出一已之见。全文共分为四个部分。第一部分,受贿罪之比较研究,择选我国封建法典唐律、香港地区刑事立法、台湾地区刑法、日本刑法对受贿罪的规定,通过比较研究认为应进一步研究探讨受贿罪的犯罪构成等问题。第二部分,,从而揭示受贿罪的直接客体即国家的廉洁制度。深入分析了受贿罪的主体身份包括国家机关工作人员、准国家工作人员、其他依法从事公务的人员,并以列举的方式分析了几种受贿罪的特殊主体。在受贿罪的客观方面,着重分析了“利用职务便利”和“贿赂”的范围,并分析了受贿罪中“为他人谋取利益”应作为主观要件的原因。第三部分,受贿罪的共同犯罪研究。以实证分析与理论研究相结合的方式, 对受贿罪的共同犯罪构成要件、犯罪形式和认定等问题进行了分析。第四部分,完善我国受贿罪法定刑之建议。通过分析现行刑法将受贿罪的量刑比照贪污罪处理很不科学,受贿罪的刑罚种类设置也不合理。并提出立法建议: 应对受贿罪增设资格刑:调整受贿罪的罚金和没收财产刑;对受贿罪量刑情节及刑罚层次予以调整和完善,建立以情节为主的刑罚体系。关键词:受贿罪:犯罪构成:共同犯罪:立法完善 Abstract Based on the research on the crime of accepting bribes,which mainly paratively study of bribery crime among foreign countries,crime constitution, compliance crime and criminal and legislative experiences,some suggestions aregiven about how to perfect the current criminal penalty of the bribery crime.
