I 摘要娱乐场所是向公众开放的,消费者自娱自乐的营业性歌舞、游艺等场所,具有娱乐性、公共性、经济性等特征。但娱乐场所在推动社会经济发展的同时,亦诱发了诸如青少年失教、“黄、赌、毒”犯罪猖獗等系列社会问题,其社会负面效应也已成为社会公众关注的焦点。公安机关必须加强娱乐场所的监管。我国加入世界贸易组织以前,公安机关在对娱乐场所的监管中,实施治安许可程序混乱,乱收许可管理费,治安许可监督不力。现阶段,我国娱乐场所治安监管存在立法不规范和执行监管难等问题。在娱乐场所的治安监管中,公安机关处于权力和责任非对等的状态,监管程序规定错位, 公安机关超范围监管,公安机关内部亦分工不明确。存在的主要问题有:一是公安机关对娱乐场所进行事后监督检查难以从根本上监管娱乐场所,难以降低娱乐场所发生违法犯罪的可能性。二是治安监管行政监督检查不严,不规范,执法标准不一。三是治安监管过于依赖行政强制手段,非政府组织作用不明显,行业自律机制缺失、自律作用较弱。完善规范我国娱乐场所治安监管,要借鉴其他国家或地区的成功经验并结合我国的实际情况,从完善规范娱乐场所监管的立法着手,积极推行娱乐场所治安监管体制改革。依法规范娱乐场所治安监管的具体监管行为;建立预防性控制机制,从加强娱乐场所内部管理的角度出发,运用多种非强制性的行政管理手段对娱乐场所进行控制;推进治安监管行政的民主化改革, 刚性管理和柔性管理相结合,发挥非政府组织的功能。关键词: 娱乐场所治安监管依法行政 II Abstract Entertainment venue is open to the public , and is the business place where the consumers entertain themselves .The venue is of the characteristics of amusement, open to all, and economics. While pushing foreward the social and economic development, the entertainment venue also leads to the j uvenile delinquency, pornography, gaming, and drug-abuse, the series social pr oblems. The negative effect of that has e the focus of the public attention. The police must strengthen the entertainment venue supervision. Before China's accession to the World Trade Organization, the police, in the course of supervision, does impose fees randomly to the venues and supervises weakly in the public security permission with the confused procedures of public security permission. Currently, there exists the non-criterion in the law-making of the public-security supervision and the difficulties in the implem entation. As for the venue supervision, the police does not enjoy the same amount of duty as opposite to the responsibility.
