山东大学硕士学位论文摘要群体性事件在我国当前频繁发生,成为一个突出的社会问题。群体性事件是社会冲突的表现形式之一,它的发生有着深刻的政治、经济、社会等原因。群体性事件的频发反映了社会转型时期社会矛盾冲突增多、加剧,且突破原有的社会稳定机制。社会经济体制从计划经济向市场经济转变,鼓励一部分人先富起来,收入调节机制不健全,贫富差距不断拉大,社会阶层分化明显,而政治体制改革明显滞后,社会运行机制也没有及时转型,导致经济基础与上层建筑的不协调,有的社会矛盾无法在体制内解决,弱势群体就选择体制外的非正常聚众上访、聚集请愿等方式来表达利益诉求, 从而形成群体性事件。群体性事件对社会稳定和经济快速稳定发展都构成了极大的威胁。上至中央,下到地方,科学、合理、妥善解决群体性事件成为党和政府的必修课。公安机关作为政府的重要职能部门,是社会治安秩序的主要维护力量,遇有群体性事件理所应当担负起处置的责任,在党委和政府的统一领导下,积极主动协助相关部门平息事态,恢复社会秩序。然而,群体性事件的复杂性又决定了处置工作的困难性,公安机关一方面要维护正常的社会秩序,防止群体性事件妨碍公共利益;另一方面要保障群众自由表达利益诉求的权利。在群体性事件中如何权衡各方利害关系,合理合法化解群体性事件,对公安机关来说是一大考验。本文从公安机关的角度,运用政府职能理论和冲突理论等,分析公安机关在处置群体性事件中的利弊得失,提出公安机关应更新观念,明确责任与要求,提高群体性事件处置水平,维护社会稳定。关键词:群体性事件;公安机关;处置 ABSTRACT Group events happen frequently inChina,and e anoutstanding social events is one ofmanifestations occurrence hasprofound political,economic,social and other events’occurringfrequently reflects theincrease,aggravation ofsocialconflictduring thesocialtransition,and they have brokenthrought11e耐Sting mechanisms ofsocialstability.
