中山大学硕士学位论文构建我国亲属作证特免权制度探析--“亲亲相隐”制度之现代解读姓名:赖勇军申请学位级别:硕士专业:法律硕士指导教师:任强 20101204 构建我国亲属作证特免权制度探析一一“亲亲相隐”制度之现代解读内容提要对亲亲相隐制度的研究,迄今为止,成果可谓丰硕,但在此研究基础上提出构建亲属作证特免权制度的学术论文并不多,有提出的多数是从刑事诉讼或是民事诉讼角度进行研究。相对比亲亲相隐制度的研究,以亲属作证特免权为题的研究相对较少。针对我国目前“失踪" 的亲属作证特免权制度,笔者试图通过对亲亲相隐制度的现代解读, 对构建我国亲属作证特免权制度作一探究。我国古代和西方都有“亲亲相隐(亲属容隐)”的法律传统,亲亲相隐制度在现代语境下,有着其独特的意蕴和现代价值。而“容隐制”仍是近代西方亲属作证特免权制度之母,现代西方立法对亲属作证特免权问题都作了明文的规定。在我国现行的立法上,此种制度基本上是空白的。当今世界,诉讼的文明化和民主化成为发展趋势,我们应该立足本土资源,学习和借鉴国外成熟的亲属作证特免权制度, 在证据制度的改革中构建起适合我国国情的亲属作证特免权制度就具有相当很重要的现实意义。本文在研究方法上采用比较研究法、文献分析法、历史研究法、价值分析法以及其他社会科学的研究方法。笔者首先对亲亲相隐法律制度进行历史考察,然后分别从伦理价值、法理、心理学、经济学角度对“亲亲相隐"制度进行了现代解读,进一步考察了亲属作证特免权制度的国内外现行立法例并对其比较分析,得出了笔者对构建我国亲属作证特免权制度的几点思考。关键词:亲亲相隐亲属作证特免权大陆法系英美法系 U ABSTRACT Relatives system ofresearch,SO far,the results can bedescribed as fruitful,but inthisstudy relative totestify on thebasisoftheproposal of building therightsystem privilege not many papers have raised the majority ofcriminal or civilproceedings from thepoint ofresearch.
