摘要

城市生活垃圾问题是随着人类社会的进步、城市的形成而逐步产生和发展
起来的。它已成为城市环境主要污染源之一。随着城市化的快速发展和人民生
活水平的提高,生活垃圾产生量迅速增加,资源浪费与环境污染日趋严重。
目前我国城市生活垃圾污染问题日趋严重。与此同时,生活垃圾中含有大
量可重复利用的资源,对节约自然资源、解决生活垃圾污染问题来说是一条“捷
径”。法律特有的权威性、稳定性、强制性对城市生活垃圾污染防治起着不可替
代的作用,因此建立科学、合理的城市生活垃圾污染防治立法体系,是改善城
市生活环境质量、实现资源可持续综合利用的重要手段。
我国城市生活垃圾污染防治立法工作还处于起步阶段,虽然现有的法律从
国家的基本法到各单项法中都有相关规定,但涉及到具体的法律制度,还存在
着很多问题。为了尽快解决城市生活垃圾的污染问题,本文对我国城市生活垃
圾污染防治的立法体系进行梳理,深入分析其中存在的问题和不足,介绍了
个国家在处理城市生活垃圾方面的先进经验通过对这些经验的国际比较总结
出种模式。并以这种模式为借鉴,结合我国的实际情况,提出了坚持以科
学发展观为立法指导思想,完善城市生活垃圾污染防治法律体系。并逐步建立
与市场经济发展相适应的各具体法律制度。从而使城市生活垃圾污染问题从根
本上得以缓解。

Abstract

As the development of society and human beings and the rapid urbanization, Pollution of
Urban household refuse, a major pollution in city, gets much worse, when the rapid economy and
higher life standard going on.
As we are still at the beginning of preventing and curing urban rubbish pollution by legislation,
it exists many fault in our laws; although there are many regulations about rubbish in existing laws.
In order to improve our work on the pollution of garbage in city ,the paper will introduce the law
system on rubbish preventing and curing in China, find the deficient in our laws. and at the same
time, the paper will also introduce some experience of 9 countries— 6 styles, which have advanced
laws on the pollution of rubbish paring the system of our country and that of others. Then
gives some advice to promote the legislation on pollution of rubbish in China, range from principle
of law to the concrete system.
