黑龙江大学硕士学位论文 Abstract Service liability refers toliability fordamage which should be bear by business operators whose services do not have reasonably expected safety,which leads to personal and property damage Consumer Protection Law has regulated the service liability ofoperators,which has filldeinthe blank of service liability ,there aresome ings whether inthe current legislation ortheoretical research on some legal issues which are involved inthe fieldof SerVlCe. The paper takes operators’service liability as the research object,and after explaining theconcept ofoperators’service and service liability,this paper analysis the theory and legislation ofservice liability athome and abroad,and points out the inadequacies oftheserviceliabilitysystem paper argues that theservice liability is akind ofspecial tortliability,and on thisbasis,the paper starts with the perspective of better for consumer protection,learning lessons from advanced experience,based on national conditions and analyzes the imputation principle and elements of service liability,through analysis,the paper finally offers some mendations forimprovement.
