票据抗辩理论问题研究

票据抗辩制度可以说是票据法领域一个比较有特色的制度,票据抗辩的分类
方法、抗辩的切断制度都是值得我们研究的重点,但是以往对票据抗辩制度的研
究并不注重票据抗辩理论与票据理论的关联,这使得票据抗辩的实践问题与票据
基础理论严重脱节,造成了研究无法深入的困境。同时,很多票据抗辩问题在法
律中都没有详细的规定,并且在一定程度上讲也很难以条文的形式来规范较为复
杂的票据抗辩问题,因此在理论上对这些问题进行研究显得尤为重要。同时,票
据理论与票据抗辩理论的统一,甚至理论与立法和判例的统一都是我们在理论上
所要追求的理想状态。因此,在本文中将以一个具体的抗辩类型作为视角来阐述
在票据抗辩的各个环节中票据理论所发挥的重大作用,并通过第二章对各种票据
理论学说的比较、第三章对票据抗辩分类方法的借鉴、第四章对票据抗辩切断制
度的介绍,评选出了一个较为理想的票据理论——二阶段创造说,并试图将其运
用和贯穿在整个票据抗辩领域。同时在文章中运用了多种研究方法,首先,从票
据抗辩的概念入手,通过概念分析的方法明确票据抗辩的内涵和外延。其次,运
用历史分析的方法,探明票据基础理论的发展历程,理解各种学说主张的观点。
再次,通过比较分析的方法,研究各国对票据抗辩的分类方法和关于抗辩切断制
度的规定,通过比较其各自的优缺点,进行合理的借鉴。最后,通过法经济分析
的方法,对票据理论学说做出选择和评价。
