文章摘要法律是一种抽象规范,不直接指涉具体情境中的个别行为和特定事件。将法律适用于具体案件的过程都必然涉及到解释问题。因为法律从其以成文的形式产生伊始,就与解释问题唇齿相依,法律通过解释媒介成为现实,而解释者成为法的精神的传播者。我国目前法律解释包括立法解释、司法解释和行政解释, 并没有司法裁判中法律解释的存在。法官没有法律解释权,法官审判以立法机关的成文法规为准则,参照两高的司法解释。但实践中法律解释在法官裁决纠纷的过程中确实存在。因此中国司法裁判中的法律解释面临一个尴尬境地:无其名却行其实。如何正确认识司法裁判中的法律解释,如何解决中国司法裁判中的法律解释的缺失,如何化解司法裁判中的法律解释在实践和制度上的冲突,如何在我国引入司法裁判中的法律解释并使其在实践中健康地发展是本文的研究目的所在。关于司法裁判中的法律解释应否存在以及应如何存在等问题,大陆法系和英美法系有关法律解释的发展史已经为此提供了实践经验,同时,不同的学派对法律解释如何存在也给出了不同的理论借鉴。本文在考察西方法律解释的发展历史和理论流派的基础上,并重点结合中国现实情况,提出我国司法裁判中的法律解释的构建与完善的建议,以求对现行的司法改革有些许裨益。【关键字】立法解释;司法解释;行政解释;司法裁判中的法律解释 Abstract The law one abstract standard,which doesn’trefer totheindividual behavior andthespecific event inthe concrete interpretation willbeneeded when laws areapplied totheconcrete thelaw asclose as lipsand teeth withtheinterpretation ofthelaw,as thewriting form oflaw e intobeing.
