横向垄断协议规制分析研究.pdf

横向垄断协议规制研究中文提要横向垄断协议规制研究中文提要反垄断法作为现代经济法最核心的组成部分之一,是各国发展市场经济所必不可少的基本法律制度,而对垄断协议的规制又是各国反垄断法的核心制度之一。本文采用比较分析的研究方法,在借鉴西方国家的理论成果和立法经验基础上,结合我国刚刚颁布的《反垄断法》的相关规定,对横向垄断协议的概念、构成要件、分类、适用原则及法律后果等加以评析,同时指出,我国《反垄断法》关于横向协议的法律责任、反垄断执法机构设置的规定存在不足之处,以及横向协议豁免程序制度的缺失。在此基础上,笔者提出了以下几点完善我国横向协议制度的建。议:1)引进国外的惩罚性赔偿制度;2)规定横向协议的刑事责任;3) 设置一个专门的独立的权威的反垄断执法机构;4)确立横向协议豁免程序制度;5)完善宽恕制度。关键词:横向协议市场竞争惩罚性赔偿豁免规制作者:章卿指导教师:曹博教授墅!竺兰!!竖!!型!竺!!!塑塑竺型!受!竺!!望垒!墅型 Research 011regulations ofhorizontal agreements Abstract As one of themost centralparts position inthe area ofthemodem economic law,Anti--Monopoly Law istheindispensable andbasic legal system foreach country to develop the market the prescription towards monopoly agreemem is one ofthemostcentralsystem of Anti--Monopoly Law among different parative analysis ofresearchmethods,learn fromWestern countries in thetheoretical results and legislation on thebasis ofexperience,OUr country hasjust promulgated the”anti-monopoly law,”the relevantprovisions of theconcept of horizontal monopoly agreemem,.constitute elements,classification, applicationPrinciples andlegal consequences toassessment,also pointed out that China's”anti-monopoly law”horizontal a铲eemem on responsibility ofanti—monopoly law enforcement agencies set up the inadequacies oftheexistingprovisions,as wellashorizontal agreements exemption procedures system the basis ofthi.'s,the author made thefollowing pointsimprove our system ofhorizontalagreements and mendations:1)the introduction offoreignpunitive damages system,2) the criminal provisions ofhorizontal agreements,3)set up a special independent authority oftheanti—Monopoly law enforcemem agencies,4) established system ofhorizontal agreements and exemption procedures;5) improve thesystem ofleniency.
