摘要
从世界范围看,反垄断法从诞生以来已经有一百多年的历史,约有上百个国家和
地区都制定了符合本国需求的反垄断法。随着反垄断法的不断发展,反垄断的实施机
构也越来越受到重视并不断被完善。各国反垄断法实施机构的设置,有其共性,如高
度的专业性、权威性,并拥有广泛的职权,当然各国的反垄断机构具体设置,也是和
本国国情结合在一起的,各有各的特色,研究各国的反垄断体制,对于目前我国完善
反垄断实施机构有一定的启示作用。随着我国经济体制改革的深化,产生了垄断滋生
的土壤,垄断现象越来越成为我国经济发展的重大阻碍。我国的反垄断法实施以后,
能不能更好地促进经济发展和实现立法意图,关键在于能不能建立一套适合我国国情
的反垄断法实施机制。
《反垄断法》已经开始实施,但是该法关于反垄断实施机构的规定更大程度上是
寻求立法和行政执法的平衡,在实践中留下了很大的待完善空间。本文拟针对这一现
况,通过分析目前我国现有的反垄断实施机构系统,并比较各国的反垄断机构设置,
提出对我国反垄断法实施机构的重构,指出我国反垄断的实施职责应当由反垄断委员
会承担,并最终确定对反垄断委员会的重构分两步走:第一步是在加强其议事协调功
能的同时赋予其一定的行政反垄断权力;第二步是时机成熟时整合现有反垄断机构的
所有反垄断权力,收归反垄断委员会,使其成为我国反垄断实施的唯一的专业性机构。
建立有效的反垄断实施机构,对于改善我国的反垄断实施情况,推动我国的国民经济
发展具有重大意义。

Abstract
From a global perspective, it has been 100 years from the inception of anti-monopoly
law, about more than a hundred countries and regions made anti-monopoly law according
to their national needs, with the continuous development of anti-monopoly law, the
anti-monopoly institution has been paid more and more attention and is being improved.
The setting of anti-monopoly agencies of each country has something mon, such as
the high degree of professionalism, authority and a broad power, of course, the specific
setting of each country bined with their own national conditions, with their own
characteristics, to study the anti-monopoly system of other countries is benefit to our
country. Along with the deepening of China's economic reform, causing the breeding
ground of monopoly, monopoly has increasingly e an obstacle to China's economic
development. After the implementation of China's anti-monopoly law, it depends on a set of
anti-monopoly law enforcement mechanisms to realize the economic development and the
legislative intention.
