论我国商标权限制法律制度的完善

摘要
由于我国立法对商标权限制规定的滞后,商标权人滥用权利的现象不断,导致
商标权人与合法使用人的权利冲突越演越烈,司法和执法适用标准缺失。反观国际
和各国的商标立法,无不规定了较为完备的权利限制制度。因此,构建国内完备合
理的商标权限制制度显得尤为重要。基于此,本文首先阐述了商标权限制制度的内
涵和法理基础,接着分析我国商标权限制制度的立法现状及不足,进而提出商标权
限制进行法律规制的必要性;然后分析国际和各国对商标权限制制度的立法动态和
发展趋势,国外对商标权的限制不仅局限于自身的制度设计,如合理使用制度、在
先权制度和商标权用尽制度等传统商标权限制制度;而且更进一步与反不正当竞争
法、反垄断法等法律相结合,商标权在竞争法上的限制,突破了商标权限制制度仅
局限于内部限制的传统,解决了单纯依靠商标法对商标权限制的不足。最后在借鉴
国外成熟的立法的基础上,提出对我国商标权限制应从内部限制与外部限制相结合
的构想,即在商标法内部采用原则性规定和列举式规定的立法模式;在商标法外部
提出完善竞争法对商标权限制的立法建议。期望对我国商标权限制制度的立法和执
法有所裨益。

Abstract
The limitation of trademark rights legislation is impefect in our country,so that
abusing trademark rights is not mon in practice, which leads to escalate rights
conflicts between trademark owner and user, judicial activities and administration are lack
of legal basis. On the contrast, other nation’s legislation and international legislation have
provided detailed principles to the limitation of trademark , establishing a
prehensive and reasonable system of trademark rights limitaion is particularly
important. Based on this, First,this paper elaborates the meaning and legal basis of
trademark rights limitation system , then analysis the legislation actuality and
insufficiency of trademark rights limitation system in our propose the
necessity that provide the legal regulation to trademark rights limitation. Next analysis the
development of international trademark rights limitation legislation system. Overseas,
limitations to trademark rights are not only limited to those traditional system design in
trademark law, such as fair use, priority use ,exhaustion of the trademark rights ,but also
combined with the laws on petition and antimonopoly law which solve the
problem of trademark rights limitation not only in trademark law.
