反垄断行政执法体制分析研究.pdf

山东大学硕士学位论文内容摘要反垄断法是维护经济民主和经济自由的基本法,有“经济宪法”之称。反垄断法制定之后,能否促进经济的发展和实现立法的意图,关键在于其执法效果的好坏。在既定的社会环境下,这首先要求要有一个适当的反垄断执法机关:要有一个健全的实体和程序规定。本文介绍了反垄断执法体制的形成及反垄断执法的涵义,并选取了执法体系中的几个问题作研究对象,从美国、日本和欧盟的反垄断执法主体和案件的基本处理程序入手,找出共性,割析我国的现行的和草案中的反垄断执法主体、案件基本处理程序。本文还对执法中应贯彻的原则作了简单探讨。文章除引言和结语外,共有四部分。第一章,反垄断执法体制概述。介绍了反垄断执法体制的形成,反垄断执法的概念以及和司法的异同,并对本文的研究范围作以界定。第二章,美、日、欧反垄断执法主体和执法程序。美日欧的反垄断执法主体设置有差异,但都有独立、权威、专业的共同点。详细介绍三者的执法程序,归纳出其执法基本程序都有立案、调查、审理和裁决的步骤。第三章,我国现行反垄断执法的主体和基本执法程序问题。由于我国目前反垄断多头执法,本章主要介绍了工商行政管理部门设置和职权,以及其对案件的处理程序。参照他国经验作简要评析。第四章,完善我国反垄断行政执法体制的思考。针对现行反垄断执法中存在的一些问题,笔者认为应该将反垄断执法的原则贯穿于执法过程始终。原则是制度的灵魂, 在我国反垄断执法中应该贯彻公正、公开和效率原则。‘反垄断法》草案(全国人大常委会一读稿),借鉴了许多优先制度。但对执法主体、程序规定上有较大缺陷,笔者对照各国执法机构的特性、执法程序中的共性,提出建议。将草案中程序规定从纵向和横向上对照(与送审稿和外国法上),提出需要完善之处。关键词;反垄断执法;主体;程序;原则》奴刎0≈门山东大学硕士学位论文 Abstract Anti-monopoly law is a basic Law which safeguards economic democracy and economic fi'eedom,SO people call theeconomic it can promote economic development andbefitfor thelegislativeintent isrelated tothequality oflaw enforcement certainsocialcircumstance,it firstrequires allappropriate anti-monopoly lawenforcementagency,SO do substantial andprocedural rules.
