论民事执行中的司法拍卖内容摘要 I 论民事执行中的司法拍卖内容摘要从我国民事诉讼程序立法对司法拍卖的法律规定考察及我国司法拍卖在执行实践中的发展历程,可看出司法拍卖实施方式的改革是我国司法拍卖制度自建立以来的一条极其重要的主线,这背后体现出诉讼法学界及其他社会领域对司法拍卖特性及其性质的不同理论认知。近年来民事执行领域对司法拍卖模式的改革成果——上海法院司法拍卖模式、重庆法院司法拍卖模式和浙江法院司法拍卖模式,恰恰切中要点地反映出司法拍卖的理论症结。这亟需理论界对司法拍卖的相关理论作出解释、梳理。本文在此研究基础上通过进一步研究司法委托拍卖中受托拍卖机构的法律地位现状及司法拍卖程序所存在的问题,最终对我国司法拍卖制度中受托拍卖机构的法律地位理论与司法拍卖程序及其法律效力等进行理论完善。关键词: 司法拍卖模式司法委托拍卖法院自行拍卖作者: 吕洁指导老师: 张永泉 Abstract Research on The Judicial Auction of Civil Execution Procedure II Research on The Judicial Auction of Civil Execution Procedure Abstract From the investigation of the legislation of judicial auction inour country civil procedure law and the development course of the execution practice of judicial auction, we can see that the reform on the operation way of judicial auction isa very important line since the establishment of the judicial auction system, which reflects the different cogniti on on characteristics and properties of the judicial auction in procedure law circle and other social fields. In recent years, the reform of judicial auction in the field of the civil execution, Shanghai judicial auction model, C hongqing judicial auction model and Zhej iang judicial auction model , precisely reflects the judicial auction theory problems to the point. It need to explain b the theory of judicial auction. B ased on the study ,by further research of the present situation and problems of the legal status of the judicial trustee in trust auction institutions and the existing problems in the judicial auction process, this paper finally improve the theory of the legal status of the trustee institution inour country judicial auction system , its procedure and the legal effect .
