本文除了引言外共分为三大部分。
第一部分是选举权与村民选举权概述。本部分通过对选举、选举权、村民选举权等
现有概念进行比较分析,提出自己关于这些核心概念的重新定义并对这些概念的外延进
行界定。这些概念如何定义以及外延如何界定决定了本文的展开。第二部分分析了村民
选举权受侵害及其救济状况。首先,分析了村民选举权受侵害的状况与原因。其次,分
析了村民选举权救济现状与问题。实践中村民选举权利救济渠道并不通畅。作者认为存
在三个原因:村民选举权利救济缺乏完善的法律;相关救济主体的救济功能未得到充分
的发挥;部分党政官员和村民对村民选举权利的重要性认识不够。第三部分是我国村民
选举权利救济制度的完善。“有权利必有救济”法律不仅要宣示权利的存在,更重要的
是为权利提供保障和救济。村民选举权利救济制度的完善是一个长期的综合的过程,既
需要我们制定一部村民选举方面的专门法律,又需要提高认识,完善投票技术和设施保
障,预防侵害村民选举权利行为的发生,为村民选举权利的多渠道救济创造良好的外部
环境。

Abstract
This article is divided into three parts in addition to the introduction.
The first part is an overview of election right and villagers'election right. This section
presents the re- definition of these core concepts and the extension of these concepts to define
parative analysis of the existing concept of the election、villager election、villagers'
election right. How these concepts are defined epitaxial determine how to define the
commencement of this article. The second part analyzes the villagers'election right the victim
and its relief situation. First, the paper analyzes the villagers'election right against the
situation and the reasons. Second, the paper analyzes villagers'election right relief situation
and problems. In practice, the relief channel is not smooth. According to the author, there are
three reasons: The villagers'election right relief lack sound legal;the main relief function has
not been fully exploited;Part of the party and government officials and villagers ignore the
importance of the villagers'election right. The third part is how to improve the villager'
elections right relief system. "There is right, there is relief" and the law shall not only
declare the right but also dispose the appropriate relief system. Building the perfect villagers'
election right relief
