万方数据万方数据论行贿罪之“为谋取不正当利益”摘要本文在认识到刑法中行贿类犯罪具有共性的前提下,选取侵害国家公职人员职务廉洁性的行贿罪作为探讨的对象, 围绕“为谋取不正当利益”这个核心,针对三个方面的问题进行分析和研究。第一部分深入剖析了“为谋取不正当利益”的法律属性, 认为当前形势下“为谋取不正当利益”应为行贿罪必备要件, 且该要件属于主观要件, 同时刑法第 389 条第 2款的犯罪构成不应以“为谋取不正当利益”为要件。第二部分从理论分析和法条解读入手对“为谋取不正当利益”的界定进行了研究,提出现有的理论观点和司法解释都存在一定缺陷。第三部分主要探讨了“不确定利益是否属于不正当利益”、“日常送钱送物进行‘感情投资’行为是否可以认定为行贿”等司法实践中的常见问题,并且附带性地探讨了“不正当利益”的追缴问题,提出可以参照不正当利益的不同分类, 针对不同利益对象作出区别性处置规定。本文最后还对行贿罪的“为谋取不正当利益”要件提出了完善建议。关键词: 要件,不确定利益,感情投资, 追缴万方数据 THE RESEARCH OF “TO SEEK ILLEGITIMATE INTERESTS”OF CRIME OF OFFERING BRIBES ABSTRACT Based on realize the crime of offering bribe s in criminal law has the general character ,the paper selects the crime of offering bribes which against the integrity of national public officials as a study object .It focus on the core of "to seek illegitimate interests", and di vides into three parts to do the research and analysis. The first part in -depth analysis es the legal attributes of "to seek illegitimate interests" ,and the paper argues that " to seek illegitimate interests" is the essential elements and the subjective elements of the crime of offering bribes ,and it is not the essential elements of the second paragraph of article 389th of the criminal law .
