华中科技大学硕士学位论文 I 摘要随着传统医药保护的不断发展,传统医药数据库的保护也越来越受到重视。文献和数据库是传统医药的物质载体,对传统医药知识的保留、整理、发展和利用具有重要的作用。本论文首先简要介绍了研究的背景,国内外发展现状及趋势,及本文的研究目的。第二部分概括介绍了传统医药数据库保护的两种基本措施,分别为技术保护措施,和知识产权保护。在传统医药数据库技术保护措施方面,简要介绍了技术保护的方法,并分析了其局限性;在知识产权保护方面,首先从经济学的角度分析传统医药数据库的法律属性,并概述了几种主要的知识产权保护措施。第三部分,主要探讨传统医药数据库的版权保护问题,本部分首先介绍了以版权保护数据库的国际公约和国内法,其次分析了各国对数据库予以版权保护的现状,重点分析了美国和中国。在美国的数据库版权保护研究中,通过典型案例分析, 总结了其两个主要的数据库版权原则,最低独创性原则和版权弱保护原则。在对我国的数据库版权保护研究中,以“中国大法规数据库”侵权案为研究出发点,总结了我国数据库的版权保护的现状。第四部分,分析传统医药数据库的特别权利保护问题,包括权利主体,客体, 内容,期限,限制等问题及不足,得出结论:特别权利所确立的数据库特别保护体系的根本目的是要保护数据库制作者在制作数据过程中的投资。此外,这部分还分析了传统医药数据库的反不正当竞争保护,商业秘密保护和商标保护。文章的结尾部分对我国传统医药数据库的保护提出相关建议和对策,如充分考虑“额头出汗”和“辛勤收集”原则,适度降低目前我国数据库的独创性要求; 保护投资者利益同时,注意平衡公共利益;建立以版权法保护为主,兼用其他保护方式的综合保护体系。在对未来的研究展望中, 提出要不断完善我国传统医药数据库的法律保护体系,使我国的传统医药数据库法律保护制度最终定能实现效率与公平双重目标。关键词: 传统医药数据库知识产权保护版权保护特殊权利华中科技大学硕士学位论文 II Abstract With the development of traditional medicine protection, the protections of traditional medicine database have been given much emphasis. The publications and databases are the substantial carrier of traditional medicine knowledge, which play important role to the reservation, arrangement, development and uti lization of traditiona l medicine knowledge. In the first part, the pape r briefly introduces the rese arch background, development situation both domestic and overseas, and the research purpose. In the second part, it analyzes two basic methods for traditiona l medicine database protection, which are technical protection and Intell ectual Property protection. Fo r the technical protection, the paper introduces the technical protection methods as well as the limitation; as for the Intellectual Property protection, it analyzes the juristic attr ibute of traditional medicine database from the point of view of econo mics, and summarizes the main protection methods of Intellectual Property protection.
