摘要,I,dab≮本文将人力资本理论、产权理论以及现代企业理论结合起,运用规范与实证、定量与定性、比较分析等方法,从理论实证两方面比较全面系统的探讨人力资本收益权的基本问题其实现机制,初步构建一个人力资本收益权理论分析框架, 新的角度来分析和理解收入分配机制和制度。人力资本完全具备了资本的本质属性,是资本的一种形式, 为了获得利润所做的投资,人力资本所有者也应该拥有企业昕有权,参与企业的利润分配,得到与其资本性质相对应的本报酬。但它毕竟是不同于物质资本的一种特殊资本,在实中人力资本的收益权难以得到保障,我们可以通过制度设计, 别是经济制度、社会制度、法律制度设计,使人力资本实现汉化,参与企业利润分配,实现人力资本收益权。本文在对比分析发达国家与我国人力资本收益权实现现状实现方式的基础上,指出我国在人力资本收益权制度安排和[见人力资本收益权方式等方面存在一些不足之处,从法律、场等方面分析了问题存在的原因,提出了相应的对策建议, 为人力资本折价入股、改进和完善的股票期权计划、职工股方式能够有效实现人力资本收益权。建词:人力资本;产权;收益权;制度设计;实现方式 bining the theory of human capital,property rights and modern enterprise with the theoretical and empirical studies,quantitative and qualitative analysis,parative analysis,etc.,this paper di SCUSSeS systematjcalIy the basic problems of human capital gain rights and the mechani sm Sof realizing the right from both the theoretical and empirical structures a frame for analyzing human capital gains right theory and discusses the e distribution mechanism and system from anew angle tentatively.
