西安建筑科技大学硕士学位论文西安建筑科技大学硕士学位论文陕西省矿山环境生态化法治研究①专业:环境与资源保护法学硕士生:高伟指导教师:刘华副教授摘要陕西省是我国矿产资源大省之一, 陕西省的矿业活动为国家经济建设做出巨大贡献的同时也对其矿山生态环境造成了严重的损害。本文在国家和陕西省“十二五规划”发展战略的背景下, 从矿山环境生态化的概念及可持续发展的基本理论出发, 调研陕西省矿山环境的现状, 指出矿山自然环境离生态化的要求相去甚远。因此, 本文以生态文明为视角, 运用比较、分析、综合, 归纳、演绎以及系统分析等多种方法, 从立法、执法、法律监督三个方面深度剖析陕西省矿山环境法治建设存在的问题, 指出陕西省矿山环境法治建设与生态化要求亦相差太远。在具体分析美国矿山环境法律制度的基础上,指出陕西省现行矿山环境法律制度存在的弊端并提出借鉴意见。最后, 从法治理念、法律制度、法律制定和法律实施四个方面提出了加快陕西省矿山环境生态化法治建设的具体策略, 通过法治的手段来改善陕西省矿区的生态环境, 使其达到生态化的要求,同时为陕西省矿业经济的可持续发展保驾护航。关键词: 矿山环境生态化法治立法执法法律监督本论文得到省软科学项目——《陕西省矿山环境生态化法治研究》(编号:200KRM85 )的资助。西安建筑科技大学硕士学位论文西安建筑科技大学硕士学位论文 Shaanxi province mine environment ecologinization research on rule of law Specialty Specialty Specialty Specialty : : : : Law of Environmental and Resource Protection Name Name Name Name : : : : Gao Wei Instructor: Instructor: Instructor: Instructor: .
