网络新闻侵权初探.pdf

摘要众所周知,形形色色的新闻侵权现象在网络领域屡见不鲜。网络新闻侵权传播面大,危害大,在建设和谐社会的环境中,网络新闻环境的净化和改善成为不可回避的问题,网上新闻传播的无序,亟待一个明确的“说法”。网络新闻侵权问题的研究已显得十分迫切和必要,笔者对这一领域的资料进行了搜集和整理,在深入了解前人相关研究的基础上,就网络颞闻侵权的成因及规范问题进行了系统研究。从侵权的责任客体上可将网络新闻侵权分为对人格权的侵犯和知识产权的侵犯两类。本文第一章以案例说法,解析我国现行网络新闻侵权中的诸多矛盾和问题,重点剖析了两大类型网络新闻侵权中各种具体表现方式的行为特征,指出现行法律法规中的缺漏造成网络新闻侵害名誉权、隐私权、肖像权保护的不足以及网络新闻侵害著作权的有待完善之处,吁请社会各界采取一些新的行之有效的办法应对网络新闻侵权的挑战。网络新闻侵权的易发性决定于网络的传播特性。笔者扼要论述了,网络新闻侵权与网络新闻咕勺价值观、传播主体的多元化和网络新闻中“把关入”作用的削弱与缺失,以及立法的滞后等原因密不可分。本文重点探讨了网络新闻侵权的预防手段和治理措施。防范网络新闻侵权的原则是法治建设和道德建设并重。本文以自律和他律手段为大框架,分别从网络新闻记者职业层面、组织层面、行业层面和制度化层面四个层次考虑网络新闻侵权的规则、制度,并针对各个层面可能出现的问题提出预防和治理措施。关键词网络新闻,侵权,成因,对策 ABSTRACT As we know various kinds ofIntemet news transmission e a matter mon occurrence nowadays.
