摘 要
缺陷产品召回制度在当今世界各国特别是发达国家已经普遍建立和 实施，实践证明，召回制度对于维护消费者的合法权益，提升企业技术 水平及其竞争力，维护公共安全和公众利益等方面都具有不可替代的重 要作用。虽然我国对于缺陷产品召回制度已经在一定范围进行探索和实 关键词：缺陷产品；召回；法律制度
ABSTRACT
Today, the Defective Products Recall System (DPRS) has been widely established and implemented all over the world especially in the developed countries. It proves that, the DPRS plays quite an important and irreplaceable role in maintaining consumers, legitimate rights, improving the technological proficiency and competitive power of the enterprises and guaranteeing the public security and interest, just to name a few. Although the DPRS in our country has been explored and practiced in certain scope, however by now, a perfect DPRS has never been constituted. It has been eight years since we joined the WTO, and the absence of a perfect DPRS has become an immense legal obstacle for both the protection of the consumer rights and the enhancement of the enterprise competitive power. Therefore, by referring to the experience undertaken by the developed countries and associating with the situation in China, it is pretty urgent to establish and perfect the DPRS in our country.
Employing the legislation and practical experience in foreign countries, this paper is going to probe into the current situation of DPRS in China, demonstrate that this DPRS remains as a necessity, make an initial assumption on how to establish and perfect the DPRS in China. Partial constructive suggestions and proposals have also been raised, wishing that this article will provide some referenti
