【摘要】
伴随着我国法治建设进程的不断推进，法治观念越来越深入人心，人们的生活也越来越离不开法律，法律在人们的生活中扮演着越来越重要的角色，人们对法律的需求也越来越旺盛。
可是实际上在人们的生活中时有，法律与人们固有的宗教习惯风俗相冲突的情形，人们固有的宗教，习惯风俗与国家法律显得略微的有些格格不入，人们或多或少的在规避着国家法律的规范。
针对这些情况我们在立法和司法的过程中就不得不针对民间法做出相应的调整，我们在立法的时候应当适当的注意对民间法中的合理因素进行吸收融合，在司法的过程中应当更加注意发挥调解制度的作用，从而实现民间法与国家法的良性互动，为我国法治建设创造良好的法治环境。

ABSTRACT
Along with the process of building the rule of law in China, the rule of law more and more popular, people's lives have become increasingly dependent on law, law on people's lives play an increasingly important role, people on the law of demand is also more productive.
But in reality in people's lives with, the laws and customs of the people's inherent custom conflict of natural religion, people, habits and customs and laws of the State is slightly out of tune, which some people more or less in avoiding a national legal norms.
For such situations in the legislative and judicial procedures had to be for folks to make the appropriate adjustments, we in legislation should appropriate attention to civil law reasonable factors for absorption fusion, in the judicial process should pay more attention to the role of the mediation system, resulting in civil law and national law in the construction of the rule of law in China, to create a favourable legal environment.
