村民选举权利救济的分析研究.pdf

1 内容摘要本文除了引言外共分为三大部分。第一部分是选举权与村民选举权概述。本部分通过对选举、选举权、村民选举权等现有概念进行比较分析,提出自己关于这些核心概念的重新定义并对这些概念的外延进行界定。这些概念如何定义以及外延如何界定决定了本文的展开。第二部分分析了村民选举权受侵害及其救济状况。首先,分析了村民选举权受侵害的状况与原因。其次,分析了村民选举权救济现状与问题。实践中村民选举权利救济渠道并不通畅。作者认为存在三个原因:村民选举权利救济缺乏完善的法律;相关救济主体的救济功能未得到充分的发挥;部分党政官员和村民对村民选举权利的重要性认识不够。第三部分是我国村民选举权利救济制度的完善。“有权利必有救济”法律不仅要宣示权利的存在,更重要的是为权利提供保障和救济。村民选举权利救济制度的完善是一个长期的综合的过程,既需要我们制定一部村民选举方面的专门法律,又需要提高认识,完善投票技术和设施保障,预防侵害村民选举权利行为的发生,为村民选举权利的多渠道救济创造良好的外部环境。关键词:选举权;村民选举权;权利救济 1 Abstract This article is divided into three parts in addition to the introduction. The first part is an overview of election right and villagers'election right.
