第五条 拆迁人拆迁农房，应当委托有房屋拆迁资格的单位实施拆迁，并签订书面委托协议。委托协议应报农房拆迁行政主管部门备案。
拆迁人应当依照本办法规定，对被拆迁人给予合理补偿和妥善安置；被拆迁人应当服从建设需要，在规定的拆迁期限内完成搬迁。
第六条 被拆迁人所在地的街道办事处、乡(镇)人民政府、村民委员会，应当协助农房拆迁行政主管部门和拆迁人做好有关宣传动员工作，帮助被拆迁人做好有关搬迁事宜。
第二章 拆迁管理
第七条 农房拆迁行政主管部门应在收到征用土地方案批准文件之日起10个工作日内进行征用土地公告。根据经批准的征用土地方案确定拆迁区域，通知公安、建设、工商等部门和有关街道办事处、乡(镇)人民政府及金融单位，对该区域暂停办理户籍的迁入、分户，房屋新建、改建、抵押及买卖、交换、析产、分割、赠与等房屋权属变更手续和利用房屋从事经营活动申请办理营业执照等手续。因出生、婚嫁、军人复转退等落户的，按有关规定办理。
第八条 拆迁人拆迁农房及其附属物的，应当向农房拆迁行政主管部门提出申请，取得农房拆迁行政主管部门核发的农房拆迁批准文件。未经批准，不得组织实施农房拆迁。
