摘 要:本文试图探寻社会财富创造所应具有的劳动基础,通过对我国劳动合同法立法精神的解读,本文认为在社会主义市场经济条件下创造财富的劳动应当体现劳动安定、劳动自由和劳动合作三种精神品质。
关键词:财富;劳动合同法;劳动安定;劳动自由;劳动合作
在一定意义上,劳动合同法可视为一种财富立法,因为劳动在社会财富的创造中占据着决定性的地位,是财富创造的根本源泉,因而调整和规范通过劳动合同建立的劳动关系,便直接触及到社会财富的创造和配置问题。然而虽然财富主要是由劳动创造,但创造财富的劳动应当是怎样的?却是一个值得人们认真思考和讨论的问题。在不同的历史时期和社会形态中,劳动都有着不同的质的规定性及其内容和特征,这种规定性当前一般是通过法律制度来表达和确认。我国2008年开始实施的劳动合同法即是这样的一部法律
