摘要：国家赔偿范围的界定是一个重要的问题，是影响行政相对人的合法权益能否得到合法保障的一个关键因素，然而，令人遗憾的是，我国的国家赔偿范围或多或少的存在着内容的空洞，范围的狭窄等多方面的问题，本文在肯定国家赔偿法范围的积极因素的同时，从国家赔偿的两个重要方面行政赔偿和刑事赔偿来浅谈一些我国国家赔偿法的不足，并在其中穿插尝试着提出了一些自己的建议。

一 国家赔偿范围的概述
