二 国外部分国家民事诉讼反诉时间的规定
美国是英美法系国家的典型代表，《美国联邦民事诉讼规则》第12条第1款第〔2〕项规定，“原告应在接到答辩状后20日内对答辩状中的反请求作出再答辩。”第2款规定:“如果答辩是必要的，对诉答文书中的救济请求所作的事实上或法律上的抗辩，无论救济请求是本诉请求、反请求、交叉请求还是第三当事人清求，都应当在应答的诉达文书中主张。而兼具大陆法系和英美法系特色的日本，则在《日本新民事诉讼法第146条第1款规定:“被告以与本诉标的的请求或者防御方法有关联的请求作为标的为限，可以在口头辩论终结之前，向本诉系属的法院提起反诉”。事实上，上述两个司法解释中，前一个司法解释是在大陆法系传统理论思想的影响下形成的，后一种司法解释是在近年来吸收借鉴英美法系诉讼程序理论思想的基础上形成的。由此可知，关于反诉提起时间的规定，
