第十一条 承租人租赁汽车，必须出具能够证明单位或个人身份的有效证件和一定数量的保证金，必要时须有可靠单位给于经济担保。
  第十二条 租赁经营人应该按照国家有关规定向交通行政管理部门缴纳管理费，进行年度审验，并向市交通行政管理部门或者受委托的市交通行政管理机构报送营运情况统计表。
 第十三条 承租人应当遵守以下规定：
（一）      遵守法律、法规、规章及有关规定；
（二）      不得转包；
（三）      不得利用租赁车辆进行违法犯罪活动。
第十四条 有下列行为之一的，由交通行政管理部门视其情节给于相应的处罚： 
（一）     违反本办法第六条规定，未经批准擅自经营的，处以5000元以上1万元以下的罚款：
（二）     租赁经营人违反本办法第七条规定收取租赁费用的处以收取费用30—50﹪的罚款。但最高不得超过3万元；
（三）     租赁经营人违反本办法第八条、第九条规定的，由交通主管部门给于警告，责令限期改正，并可处以500元以上2000元以下的罚款。
第十五条 当事人队行政处罚决定不服的，可依照行政复议条例和行政诉讼法的规定，申请复议或提起行政诉讼。
第十六条 交通行政管理部门及其执法人员，应加强汽车租赁业管理，严格执法。玩忽职守。滥用职权。徇私舞弊的，由其所在单位或者上级主管部门给予行政处分；构成犯罪的，依法追究刑事责任。
