　　第七条　村庄建设规划应符合土地利用总体规划、城市总体规划和城乡一体化社区布局规划，根据社区控制性详细规划、总用地规模和相关标准要求进行科学编制，具体按照以下标准：
　　
　　〔一〕建设用地审批对象人均规划用地不超过90平方米，其中，；
　　
　　〔二〕城市规划区内的村庄建筑密度不大于27%；城市规划区外的村庄，可根据实际情况适当放宽建筑密度，但最高不超过35%；
　　
　　〔三〕；
　　
　　〔四〕垂直房建筑檐口高度不超过13米；
　　
　　〔五〕积极鼓励建设多层、高层水平套房，采用多层、高层水平套房的可适当增加建筑容积率，降低建筑密度〔具体标准另行制订〕。
　　
　　第八条　村庄建设规划要表达地方特色、文化特色和时代特征，应做好古建筑物、近现代有纪念意义的建筑物、军事设施、测绘标志、宗教场所、文物古迹、名贵古树等遗存保护。上述规划保护面积并计入总用地规模。
　　
　　第九条　在不突破总用地规模和规划指标的前提下，经村民会议通过，村级组织可根据批准的实施细那么，自行确定实施方案、分步实施方案和建设多层、高层水平套房、垂直房等各类住宅的比例，经镇街审核批准，报市国土资源、规划行政主管部门和新农村办备案。分步实施的，不同批次规划指标应相衔接；采用多层、高层水平套房的，应按需要合理设置大中小户型，并先予实施。
　　
　　第十条　各镇街应根据城乡一体化社区布局规划，向市规划行政主管部门申请规划设计条件，委托有资质的规划设计单位编制社区控制性详细规划，报市规划行政主管部门审核，市政府审批；社区控制性详细规划着重规划道路网、给排水、三线、公共配套等内容，住宅采用模式、建筑风格应相协调。各镇街应根据社区控制性详细规划和各村级组织的总用地规模，统一社区内村级组织意见后，确定各村建设的位置、范围，能与规划衔接的房屋尽可能予以保存。
　　
　　 
　　
　　第三章    建设用地申请与审批
　　
　　第十一条　村级组织建设用地的审批对象为以下人员：
　　
　　〔一〕村级组织实有在册成员；
　　
　　〔二〕服兵役前属本村级组织成员的义务兵、士官；

　　〔三〕入学前属本村级组织成员的全日制大中专院校在校学生；〔四〕在劳改、劳教前属本村级组织成员的正在归正人员。
　　
　　第十二条　夫妻双方均为本村级组织实有在册成员，且已领取独生子女荣耀证等法律、法规、政策规定可增
