〔一〕同一行为违反两个以上法律、法规和规章规定的，应依据不同法律、法规和规章进行分别处分。但一个执法部门对违法行为已经给予处分的，其他执法部门不再给予相同种类处分；在依法给予其他种类处分时，可以从轻或者减轻处分。
〔二〕同时具有两个或两个以上从重处分情节，并且不具有从轻处分情节的，应当按最高幅度予以处分；同时具有两个或两个以上从轻处分情节的，应当按最低幅度予以处分；同时具有一个或多个从重、从轻处分情节的，应当综合考虑，根据其主要情节作出具体处分决定。
〔三〕法律、法规规定的处分种类可以单处或者可以并处的，可以选择适用；规定应当并处的，不得选择适用。
〔四〕对轻微和一般违法行为实施单处处分；对较重和严重违法行为实施并处处分。
第八条 有以下情形之一的，依法不予行政处分：
〔一〕不满14周岁的人有违法行为的；
〔二〕精神病人在不能识别或者不能控制自己行为时实施违法行为的，但应责令其监护人严加看管和治疗；
