转移：
　　（一）流转森林和林木所有权或使用权时，在流转期限内该森林和林木所依附的林地使用权也随之一同流转；流转林地使用权时，林地上的森林和林木所有权或使用权也随之一同流转。流转双方另有约定的，从其约定。
　　（二）流转时已经取得的林木采伐许可证可以同时流转，但流转双方都应当遵守关于森林、林木采伐和更新造林的有关规定。
　　（三）依托森林、林木、林地生存的野生动物、重点保护的野生植物以及古树名木的保护义务和责任同时转移。
　　第五条  林权流转，应当有利于保护和发展森林资源，不损害国家、集体和社会公共利益，并本着依法、公开、公平、自愿、协商一致、有偿流转的原则进行。
　　第六条  县级以上地方人民政府林业行政主管部门应当依法加强对本区域内发生的林权流转活动的监督管理。
