摘要近代深重的民族危机,使当时中国人和中国各个阶层都在努力的尝试,试图通过把近代西方资本主义的生产方式、政治制度、思想文化栽移到中国来,实现国家富强和民族振兴,这样也就出现了许多在当时政治舞台上叱咤风云但却又饱受争议的人物。随着资料的发掘和研究的深入我们对这些争议人物的评价有所进步,逐渐肯定了晚清封建地主阶级改良派的林则徐、魏源,接受了康有为、梁启超的维新变法。近些年来学术上又逐渐肯定了曾国藩、李鸿章等过去被定性的反革命的人物,但我们却始终不能以辩证的眼光看待袁世凯和袁世凯在清末民初在中国军事改革中所做的贡献和影响,近些年来随着对北洋军阀的研究深入,对袁世凯自身挖掘资料也不断加深,关于袁世凯的争议也越来越大,本文前辈研究的基础上,欲从袁世凯军事改革的历史条件,袁世凯军事改革的举措,袁世凯军事改革对清末政局的影响等方面深入研究,从小站练兵开始分析袁在近代军事理论及实践为切入点,对晚清政局和中国军事近代化的影响为依据,向大家提供另一个视角分析这个复杂的历史人物,以期对发掘和还原真实的袁世凯有所贡献并能有所新见。

Abstract The essence of corporate personality is the intrinsic reason why a corporate can be an independent person in the law the establishment Of the theory of juridical person, people had never stopped the debate of the essence of the juridical the recent two or three century, corporate es the most important kind Of juridical ,it is meaningful to think about the essence of corporate personality. We want to make a systematic research about it. At first,we will talk about history of the juridical person and the classical jurists’ understanding of the base Of that,we will make an exploration on the essence of corporate can make the conclusion that a corporate is a independent construction which is confirmed by then we will try to understand the value of independent corporate personality and the denial of a corporate we can know better about the juridical person and the corporate personality.
