摘要:当前,我国保险业的发展仍然处于初级阶段,保险制度尚不健全,相关的法律法规也还不完善,导致保险诈骗活动时而发生,并呈现出上升的趋势,保险诈骗成为当前保险业的最大威胁之一。所以,对保险诈骗罪的研究有助于人们解决日常生活中所遇到的保险诈骗问题,有利于完善社会保障体系。文章主要研究保险诈骗罪的构成要件,然后分析与保险诈骗罪相关的重要问题,如犯罪的既遂与未遂,以及保险诈骗罪的共犯问题等,并在此基础上探讨相关能加强防范保险诈骗的对策和防范理论。

Abstract: Nowadays , our country's insurance industry is still in the initial stage of development. Insurance system is not perfect, at the same time, relevant laws and regulations are not perfect, lead to insurance fraud occurred from time to time and showing a rising trend, insurance fraud as the current insurance industry one of the greatest threats. Therefore, study on the insurance fraud will help people solve their daily faced by the insurance fraud problem, is conducive to improving the social security system. This article mainly for insurance fraud with real case, reaserch position of insurance fraud, then analysis and insurance fraud related to important issues, such as the attempted crime occurs,And the insurance plicity in the crime on the basis of this study related to the strengthening of preventive measures of insurance fraud.
