要
保险诈骗存在严重的社会危害性,必须加强对保险诈骗的理论研究和在司法实践中
的打击力度。在本文中,围绕保险诈骗罪的司法认定,笔者对保险诈骗罪的犯罪构成、
界限认定、犯罪形态中存在的一些疑难问题,运用对比等方法从多角度进行了细致的分
析。保险诈骗罪的客体是复杂客体,包括国家的保险制度及保险公司的财产所有权,主
体是特殊主体,仅限于投保人、被保险人和受益人,保险诈骗罪是一种直接故意犯罪,
必须以非法占有保险金为要件。数额较大是保险诈骗罪与非罪的重要标准,通过对比发
现,保险诈骗罪与诈骗罪、合同诈骗罪等相关罪名虽然存在一定的联系或相似性,但存
在明显的区别,在法律适用中不能混淆。保险诈骗罪是数额犯,存在未遂形态,保险理
赔的特殊性导致保险诈骗经常以共同犯罪的形式出现,所以案情比较复杂。保险诈骗罪
在罪数形态上主要是牵连犯问题,对牵连犯存在一罪与数罪的不同论处方式。通过本文
的论述,笔者希望能对保险诈骗理论的研究和司法实践起到一些借鉴作用。

Insurance fraud is one kind of crime which can produce serious social harm, therefore it
is very necessary to strengthen the theory research of the crime of insurance fraud and
crackdown in judicial practice. In this thesis, surrounding justice of the crime of insurance
fraud, the author points at some of the problems including the constitute of crime, the
boundaries identified and the patterns of crime, parison method, make detailed
analysis from multiple perspectives, the object of insurance fraud plicated including
the national insurance system and the pany's ownership of property, the main
subject is a special which limited to the insurance applicant, the insured and the beneficiary,
insurance fraud is a direct intentional crime that must has the main character of illegal
possession of insurance money. The large amount is one important criterion for judging
insurance fraud guilty or no guilty, through parison it could be found that although
there is a definite link or similar among insurance fraud crime, fraud crime and contract fraud
crimes, the clear distinction in the application of law can not be c
