摘要
随着改革开放进程的加快,我国的建筑业为经济建设和社会发展做出了重要贡献。但是,随着建筑业飞速发展的的发展,也产生了许多新问题,建设工程“挂靠”现象就是主要问题之一。由于建设工程“挂靠”现象的大量存在,致使工程质量无法得到保证,引发了大量的建设工程合同纠纷,扰乱了建筑市场的正常秩序、阻碍了行业健康发展,导致建筑行业的腐败,更破坏整个行业的信任度。本文根据《中华人民共和国建筑法》、《中华人民共和国招投标法》等相关法律法规,阐述建设工程“挂靠”的概念、特点,并以我国建设工程挂靠的现状为基础,分析我国建设工程挂靠产生的原因:利益的驱动,相关政策制度有待完善,市场监管存在漏洞, 缺乏行业信用体系。对此,笔者认为可以通过加速国有建筑施工企业的改制工作,完善有关违法挂靠的法律、法规,加强有关部门的市场监管,建立建筑行业信用机制等一系列措施来解决。同时笔者也希望这些建议可以为杜绝建设工程“挂靠”行为提供参考。

Abstract
With the quickening of the process of reform and opening up, the BLDG. Of our country, for the economic construction and social development made an important contribution.
