宁波市建设工程质量保证金制度完善研究
【摘要】现阶段,工程质量保证金的操作和实施存在诸多问题,制约了建筑企业的健康发展。本文调查了宁波市工程质量保证金的现状,分析了其法律性质,区分了缺陷责任期和保修期,总结了这一制度缺陷对建筑企业带来的严重影响。同时在回顾工程质量保证金问题的产生和发展历程基础上,分析了保证金争议发生的主要原因。最后,在借鉴FIDIC和NEC合同条款,以及其它省市质量保证金相关措施的基础上,系统地提出了一些完善工程质量保证金制度的建议与措施,并对其进一步的发展进行了展望。

Study on Improvement of Quality Retention Money System of Construction Project in NingBO
【Abstract】Today, there are many problems in operation and implementation of retention money of project quality. It brings great impact on healthy development of construction enterprises. This paper investigated the current situation of retention money of project quality in Ningbo, analyzed its legal nature and the distinction between the defects liability period and the warranty period, and summed up the serious impacts on construction enterprises, which due to the ings of this system. It summaries the main reasons for retention money dispute, on the basis of reviewing emergence and development process of retention money problem. Finally, in terms of the contract drawing FIDIC and NEC, and many other related measures about retention money in other provinces and cities, it systematically put forwards some suggestions and measures to improve retention money of project quality, and discussed its further development.
