摘要

宗教与法律都是历史发展过程中的产物,同属于一个社会的意识形态范畴。
宗教有其相应的仪式、信条、组织和规范体系,其通过人的内心世界和终极信
仰来调节、控制人们的行为。宗教的这种规范作用,使得宗教与法律有了内在
的联系。不可否认,在东西方社会历史发展过程中都曾出现宗教与法律相互贯
通的现象。藏族习惯法作为藏族文化体系的重要组成部分,从诞生之日起,就
与宗教有着千丝万缕的联系,在其发展过程中形成了宗教与法律(习惯法)的紧
密结合。本文首先梳理了藏传佛教与藏族习惯法的历史演变过程,进而介绍了
民主改革前后藏传佛教对藏族习惯法所产生的影响,通过研究分析得出藏传佛
教对于藏族习惯法既有积极意义,也包含着不利因素。正确对待藏传佛教对藏
族习惯法的影响对于巩固和发展民族团结,维护社会安定局面,促进社会主义
法治建设有着深刻的意义。
本文除引言和结语外,共分三个部分。第一部分梳理了藏传佛教以及藏族
习惯法的历史演变过程,通过对藏传佛教、藏族习惯法产生、发展过程的分析,
得出藏传佛教与藏族习惯法之间相互依存,相互融合的关系。第二部分首先介
绍了民主改革前藏传佛教对于藏族法律的影响,分别从刑事、民商事、行政、
环境资源以及程序方面进行了研究、分析;然后着重从“赔命价”、生态环境保
护以及民间调解方面分析论述了民主改革后藏传佛教对藏族习惯法的影响。第
三部分论述了如何正确对待藏传佛教对藏族习惯法的影响,阐述了藏传佛教对
于藏族习惯法的意义,并结合现代法治发展理念提出对于藏族习惯法的完善及
借鉴意见。

Abstract

Religion and law are products in the process of historical development, which
belong to the area of social ideology. Religion has its corresponding religious
ceremonies, doctrine, organizational and normative system, which, through the inner
world and the ultimate belief, regulate and control people's behavior. This normative
role of religion imparts it internal relation with law. There is no denying that the
ration of religion and law did exsit during the process of social and
historical development in East and West. Tibetan customary law as an important
component of the Tibetan culture system was closely related to religion from the
date of birth and formed a bination in the course of its development. This
paper first deals with the historical evolution process of Tibetan Buddhism and
Tibetan customary law and then introduces the impact Tibetan Buddhism had on
Tibetan customary law before and after the democratic reform,and figures out both
positive and negative factors of influence Tibetan Buddhism have done to Tibetan
