随着监狱体制改革的逐步推进,监狱管理理念上的滞后问题得以凸显,特别是我
国监狱职能上的设定存在重重问题。可以说,监狱职能的科学定位,对监狱体制改革
具有重要的理论和现实意义。我国于 1994 年颁行了《监狱法》,似乎对监狱的职能作
出最为权威的规定,然而遗憾的是,《监狱法》有关监狱职能的设定过于原则化,在
实践中存在诸多异化的情形。正是在这个意义上,我国监狱职能需要“回归”本位,
即实现监狱职能的纯化。正是基于此,将围绕监狱职能纯化的相关问题,着重探讨我
国监狱职能的历史流变(特别是其对后来监狱职能定位产生的影响)、我国监狱职能
纯化的标准(监狱职能的科学定位)、我国监狱职能异化的表现形式、原因及其产生
的影响、我国监狱职能纯化的具体径路做出详尽的分析和阐释。

Abstract
Along with the prison system reform gradually propulsion, the management of prison
idea lag problem to highlight, especially our country jail function on the setting of the
existing problems. That is to say, the function of prison scientific orientation, the prison
system reform is of important theoretical and realistic significance. Our country in 1994 to
be the the prison law, it seems that to the function of prison to make the most of the
provisions of the authority. But unfortunately, the prison law about prison function set too
principle change, in practice, there are many alienation situation. It is in this sense that our
country jail function need "regression" standard, namely, to realize the function of prison
purification. It was just based on this, will focus on the function of prison of the related
