内容摘要罚金刑属于从刑的一种,随着社会的进步,刑罚轻缓化的要求进一步加强。财产刑特别是罚金刑,引起了人们的重视。1997年颁布修订的刑法典,立足于中国处于社会主义初级阶段这一基本国情,同时积极合理地借鉴国外有益的立法经验,扩大了开放性刑罚,是中国社会进步的重要标志之一。按照我国刑法典的解释,罚金刑是人民法院判处犯罪分子向国家缴纳一定数额金钱的刑罚方法。但是应当指出的是,修订后的刑法在罚金刑的数额、罚金刑的执行等方面规定过于原则,在一定程度上制约着罚金刑的科学性和执行的可行性,导致司法实践中出现了罚金刑执行难,空判多,执结率低等现象。本文分为四个部分:第一部分是引言,笔者对本文写作的意义进行了阐述。第二部分笔者对罚金刑的立法现状及立法缺陷进行了分析和阐述,对97年刑法罚金刑制度设计进行了立法综述和评价。第三部分笔者对我国罚金刑的执行现状及原因分析和评价,指出了客观存在的许多问题。第四部分是文章的重点,笔者对我国罚金刑问题进行了立法建议,譬如改革和完善我国刑法的有关规定;修改刑事程序法,建立完善罚金刑执行体制;建立判前主动缴纳罚金刑保证金以及判后主动配合执行罚金刑鼓励制度;创设三种新的法律制度,以保证罚金刑的执行。关键词:罚金刑执行现状立法建议1AbstractFine penaltyisone of the types of accession punishment in Criminal law.
