论食品安全的刑法规制中文提要I论食品安全的刑法规制中文提要食品安全一直是关乎国计民生的大事。让民众安居乐业,首先要让其在饮食安全方面没有顾虑。但是在对我国食品安全状况观察之后,却可以得出我国食品安全形势比较严峻的结论。为了能够最大限度地保证食品发挥其应有价值,加大对侵害食品安全的行为的规制力度、完善规制体系就很有现实意义。纵观古今中外,有关食品安全的规制方式可以说比较多而且不乏经典做法,但是其中的刑法规制却相对较少。笔者以为,这除了与先前食品安全没有成为社会性甚至全球性的问题有关之外,刑法这一规制方式本身的严厉性特征也使其在适用上一再后延。但是,严厉不能简单地等同于严密。通过对刑法在食品安全问题上的规制分析,我们可以发现,我国刑法在该问题的规制上,既体现出了其保障人权、打击犯罪的职能,却也存在一些不足,例如规制范围偏窄、刑罚力度可再提升等。基于上述考虑,本篇论文遵循从一般到特殊的思路,先是对食品安全的国内外刑法规制状况作一简单梳理,然后论述我国刑法在食品安全规制方面存在的问题,之后是提出一点建议,最后予以归纳总结。实际上,“食品安全”是一个常提常新的问题,而不是简单地通过包括运用刑法等法律方式及其他方式予以规范就可以一劳永逸的。要真正做到让食品“安全”,还需要从理念转变、从刑法与其他法律部门的协作衔接等方面入手,去做好相应工作。关键词:食品安全;刑法规制;问题与建议作者:张广建指导教师:李洪欣AbstractOn the Criminal Regulation of Food SafetyIIOn the Criminal Regulation of Food SafetyAbstractFood safety has been related to a colossal task.
