摘要生育保险是国家通过立法,在怀孕和分娩的妇女劳动者暂时中断劳动时,由国家和社会提供医疗服务、生育津贴和产假的一种社会保险制度。生育保险作为社会保障的一个重要组成部分,其实施有利于促进女性就业、保障社会及家庭安定、促进社会和谐发展。党的十六大提出了构建和谐社会的发展目标,其中尊重女性,保障妇女的合法权益,完善生育保险政策是和谐社会的重要组成部分。生育保险也由最初的政府负担,发展到企业负担,又逐渐向政府、企业、个人三方共担发展。在这一变革过程中,原本实施的生育保险政策存在的问题日趋突出, 另外,某些企业在巨大的市场经济压力面前,为了减轻负担,获得最大利益,往往对生育保险不加重视,甚至逃避参保,因此也导致了生育保险政策实施中的种种问题。笔者在分析国内、外生育保险模式的基础上,从生育保险覆盖范围、享受待遇的资格条件、生育保险基金的筹集与发放等几个方面对对国外生育保险模式作了比较分析,从中总结了一些可供我国借鉴的经验。另外通过梳理我国生育保险政策的演变历程,总结了一些生育保险政策存在的问题与困境,从生育保险立法、覆盖面、基金征缴与给付、政策监管等几个方面加以阐述。在目前的经济条件下,我国生育保险政策的建立与完善应当充分发挥政府的主导作用。笔者提出为了解决这些问题,政府应从以下几个方面来承担生育保险责任:一是政府承担生育保险政策制定的法律责任;二是政府承担生育保险政策覆盖的公平责任;三是政府承担生育保险政策实施的财政责任;四是政府承担生育保险政策监管的主导责任;五是政府承担生育保险政策完善的创新责任,六是政府承担生育保险政策的其他相关责任。关键词:生育保险,生育保险政策,政府责任 Abstract The maternity 1nsul'ance is one of asocial insurance system that the states or the government providewomen workers withmedical services,maternity allowance and maternity leavewhenthey 10sethework abilityduring theirpregnancy andchildbirth.
