摘要
玩忽职守罪是国家机关工作人员对工作严重不负责任,不履行或不正确履行职
责,造成公共财产、国家和人民利益遭受重大损失的行为,是渎职犯罪中最主要的
罪名之一。公共财产、国家和人民利益遭受重大损失是玩忽职守罪的构成要件。
司法实践中,如何确认玩忽职守罪的损失一直是非常复杂的问题。年月
日最高人民检察院颁布的《关于渎职侵权犯罪案件立案标准的规定》完善了
以前的司法解释的不足。玩忽职守罪的损失的法律地位可以从玩忽职守罪损失
的范围及分类、玩忽职守罪中损失的构成要件、玩忽职守罪中损失的认定三方
面分析。重大损失的分类以损失的对象、所有人、玩忽职守行为与重大损失的
因果关系、重大损失产生的原因分类。重大损失的构成要件从损失产生的主体
是国家机关工作人员、重大损失与玩忽职守行为之间具有刑法上的因果关系、
行为人主观上应当对损失具有预见性、损失的大小应达到《立案标准》的规定
四个方面分析。玩忽职守罪的损失的认定也可以分为四个方面,即,物质损失
与非物质损失的认定、玩忽职守罪的损失在时间上的认定、玩忽职守罪的损失
的扣减问题、玩忽职守罪的损失的累计问题。如有不足之处,请各位老师指正。

Abstract
