论中国法律近代化的主要特点
摘要: 发端于晚清的中国法律近代化是近代中国社会发展变迁的必然结果,对中国法制的进步与文明具有深刻的影响。中国法律近代化的演变进程,始终贯穿着批判与吸收的矛盾冲突。本文主要从法律文化形态、法律制度改革、社会历史条件及其发展过程论述中国法律近代化的特点,其西方先进法的引进、法律人才的培养、立法技术的改良、司法制度的变革,对我国今天的法律现代化有着重要的参考价值。对中国法律近代化特点的研究探讨,不止是在于弘扬传统,而且在于它能对我国当前法制现代化事业诸多启示。

On China's laws of the main features of modern times
Abstract

中国的法律近代化是指中国法律走出中华法系的固有格局而与西方工业社会法律接轨的过程。自十九世纪鸦片战争以来,随着西方列强的资本输出与殖民扩张,使得中国法律与西方资本主义法律不断碰撞、融合。因此在一定程度上可以说,中国法律近代化实际也就是中国封建传统法律向资本主义法律形态转型的过程。
