万方数据万方数据上海交通大学法律硕士学位论文论公安派出所的治安调解论公安派出所的治安调解摘要当前,构建和谐社会是我国社会发展的主旋律,但和谐社会并非是没有纠纷的社会,而纠纷的存在是社会的常态,也是社会赖以存在与运作的起点。治安调解作为我国行政调解的一种,是贯彻“调解优先”理念、化解社会矛盾、促进社会和谐稳定的具体行为。本文首先讨论了治安调解的功能,然后探讨了治安调解的适用条件和适用范围。在此基础上, 本文对治安调解现行法律规定和现实状况展开分析,归纳总结了治安调解在实践中存在的问题,并对如何完善治安调解机制、提高效能、规范程序等方面提出了构想。最后,本文对于治安调解协议的法律效力进行分析,试图进一步明确治安调解的法律地位及效力。本文力图结合工作实践,探讨基层公安机关治安调解工作中面临的困难,研究解决的方法,从而实现对治安调解制度的完善。关键词: 治安调解, 民间纠纷, 公安派出所, 法律效力万方数据上海交通大学法律硕士学位论文论公安派出所的治安调解 STUDY ON THE SYSTEM OF PUBLIC ORDER MEDIATION OF POLICE SUBSTATION ABSTRACT Nowadays, building a harmonious society is the theme of the social development in China. The harmonious society is not a society which has no dispute, because dispute is the normal phenomena in any society and the base point which produc es and operates the whole society. As one of the administrative mediation actions in our country, public order mediation is a concrete action for implemen tation of “mediation first”, resolving the social contradictions, and promotion of the social harmony and stability. In this dissertation, we firs tly introduce the function of the public order mediation, and discuss its working conditions and range of applications. Then, on this basis we analyze the existing laws and regulations a nd the practical conditions of public order mediation, summarize the problems from pr actice, and propose feasible schemes for perfecting the mechanism of public order mediation, efficiency enhancement, and procedures regulation. Finally, we analyze the legal validity of the public order mediation agreement, and try to further clarify the legal status and validity of public order mediation. Combining with the working practice, this study discusses the problems that the grassroots public security agency faced in public security mediation works, and researches the solving ways, thus achieve s the improvement of our public security mediation system.
