论文摘要
男女双方通过婚姻关系在符合法定条件的情况下成为夫妻,因婚姻关系夫妻互相
成为配偶的身份,从而产生了相应的财产关系和人身关系,即产生法律上的夫妻间的
权利义务关系。夫妻财产关系是夫妻关系的重要内容。夫妻财产是夫妻家庭生活正常
运转的物质保证,直接关系到与婚姻财产相关的民事交易安全。夫妻财产制度是婚姻
法学领域一项十分重要的制度,是婚姻中夫妻权利义务关系的重要组成部分。根据我
国新《婚姻法》的规定和当前的实际情况,本文对我国夫妻共同财产制、约定财产制、
特有财产制的问题进行探讨,对夫妻共同债务以及共同财产分割的问题进行分析,分
析了我国夫妻财产制度的现状及不足。然后从增设明确的夫妻财产关系通则性规定、
夫妻法定财产制度的完善、夫妻约定财产的完善三个方面提出了进一步完善我国婚姻
财产制度的法律意见。

Abstract
Man and woman e couple through legal conditions,
correspondingly, the rights mitments naturally appear to
each other and the main contents included are personal and property
relations. The connubial status also appears because to marital
relation, while the marital property relation stands on the key
position amongst couple relations. The marital property guarantees
the normal substance operation of family matters and directly
contacts with the civil exchange security relating to marital
property. The marital property system is one of the critical
important systems in marital laws and the key part of marital
relations. According to China new Marital Law, to study on couple
common property, conventional property, and special property as
well as analysis on mon debts and separation offers the law
suggestions to improve China Marital Property System.
