行政许可证据制度研究——以规划行政许可为视角中文摘要

中文摘要

行政许可证据,是指在行政程序中,由行政主体、相对人等依照法定程序收
集或提供的具有法定形式、能够证明行政事实存在与否并经行政主体查证属实的
所有各种形式的信息。目前,我国行政法学界对行政许可证据制度的研究甚少,
实践中行政机关对行政许可证据的认识、运用也很不规范。本文试图从行政许可
证据制度的一些基本问题入手,结合规划行政许可的工作实践,做简单的阐述。
文本主要分为引言、本体和结语三大部分,其中本体又包含三大部分:
第一部分为行政许可证据制度概述,包括行政许可及其证据制度的概念、特
征,以及对行政许可证据制度的现状分析;第二部分主要阐述行政许可的证明责
任,其中涉及对行政许可的证明标准、证明对象的简要分析,重点对行政许可的
证明责任的概念、理论渊源、分配规则等进行较为详细的阐述;第三部分是对行
政许可证据审查判断的研究,主要包括审查判断的规则、审查判断的具体情形和
方式等。
