湖南大学硕士学位论文反垄断仲裁制度研究姓名:刘璨申请学位级别:硕士专业:经济法学指导教师:郑鹏程 20110909 反垄断仲裁制度研究摘要反垄断的争议因为具有非常强的公共政策性而一直不可仲裁。近期,在欧美国家的司法与立法实践中,反垄断争议也可纳入仲裁事项的范畴。我国的法律对反垄断争议的可仲裁性问题没有作出明确规定,这既不符合国际商事仲裁制度的发展趋势,也利于我国仲裁事业的发展。我国可以借鉴欧美国家的做法,在法律中对反垄断争议的可仲裁性作出相应的规定。随着我国涉及反垄断争议案件的渐渐增多,有关反垄断争议可仲裁性的问题会明显突出,我国从立法上对有关反垄断的可仲裁性问题作出规定已是大势所趋。我们国家作为典型的制定法的国家, 不可能采取美国式的判例来确定反垄断争议的可仲裁性,只能进行相应的立法完善和一些补充。在《仲裁法》以后修订的时候,扩大可仲裁的争议事项范围,将反垄断争议具体而明确的纳入可仲裁范畴。我国现行的仲裁制度还存在许多不足与问题,在很多方面不仅不适应我国市场经济发展的需求,而且也与实际相脱节, 特别是在我国加入WTO以后,我国的仲裁制度必须与国际通行的仲裁做法接轨。面对问题多多的我国仲裁体制,出于对反垄断争议解决方式完善的谨慎态度,有必要加强对反垄断争议仲裁的司法监督。在涉及反垄断争议的仲裁协议效力的认定上,借用我国仲裁法对涉外仲裁的做法,可以由人民法院实行“报告制度’’。对仲裁员裁决时适用《反不正当竞争法》等有关反垄断的法律法规作出强制性规定。同时,借鉴欧美国家许多学者的观点:主张对仲裁裁决实施更为有效的监督, 甚至包括对仲裁员适用欧盟竞争法而作出裁决进行实体审查。关键词:反垄断争议仲裁制度司法解决行政解决 Abstract Antitrust dispute forstrong public policy and always do not belong tothe arbitration matters·In recent years,in the European and American countries the legislative andjudicial practice,antitrustdisputes can alsobeincluded inthecategory ofthe matters relating to law for antitrust dispute arbitration problems can be no definite regulation,this also was disadvantageous to the development ofarbitration undertaking in China,also do not accord with the development ofthesystem mercial country can follow the European and American countries forreference,stipulate thepractice ofthelaw ofanti—monopoly dispute inthearbitration with our country involved inantitrust dispute eases increases gradually,the dispute willbemore andmore prominent,the legislation inChina about the antitrust arbitration provisions has it’S an inevitable is atypical enacted law country,may not takeAmerican case todetermine theantitrustdispute arbitration can only plement and thearbitrationlawrevision inthe future,increase the scope ofarbitration disputes,antitrust dispute willclearand specific current arbitrationsystem in our country there are many problems inmany deficiencies
