论离婚扶养中文摘要 I 论离婚扶养中文摘要夫妻扶养制度是婚姻法的重要内容,涉及到夫妻双方当事人的利益保障,就我国现行婚姻制度而言,由于立法缺失,有关离婚后夫妻扶养的制度存在空白,在离婚时法律无法有效保障当事人,特别是弱势一方(尤其是女方)之权益,其完善势在必行。笔者通过对离婚后的夫妻扶养制度的研究,提出一些立法建议,保障离婚男女双方的权利,促进社会稳定发展。本文主要分析了离婚扶养制度的概念、历史发展、性质等基本理论,比较离婚扶养制度与我国现行婚姻制度中经济帮助与家务劳动补偿的异同,并对其他国家与地区立法例进行了介绍,在借鉴其他国家与地区立法经验的基础上,提出建立与完善我国离婚扶养制度的立法构想与建议。关键词:离婚、扶养、立法作者:叶海华指导老师:魏玉娃 Abstract A Study of Spousal Support II A Study ofSpousal Support Abstract MaritalMaintenance System is an important content of the Marriage Law for its role in protectingthe interests of the , the current legislation of our country omits this principle.
