南京师范大学硕士学位论文论我国刑法对虐待行为的规制姓名:林雪青申请学位级别:硕士专业:法学理论指导教师:刘远 20080501 摘要虐待罪是我国刑法用以规制家庭内部暴力伤害问题的重要罪名。因为受到某些传统观念的影响,虐待常被视为家务事而较少受到刑事法律的规制。随着国内外对家庭暴力问题的研究不断深入,通过法律(包括刑事法律)规制家庭暴力的需求不断增长。根据最高人民法院的司法解释,持久性、经常性的家庭暴力构成虐待,因此对虐待罪的关注程度也较以往有所提高。但是,“持久性、经常性’’概念不明确,加之虐待罪构成标准——“情节恶劣”规定也不明确,因而虐待罪的认定较为困难。本文将从直接界定“虐待"概念入手,分析现行刑法对虐待予以规制存在的问题,进而提出如何以虐待罪这一罪名规制精神虐待和婚内强制发生性行为这两种较为特殊的、也存在较大争议的虐待行为。本文主要分为三个部分。第一部分通过对虐待这一概念的界定,说明虐待是一种以控制和压制为内因的身心折磨和伤害行为,指出单以“持久性、经常性" 作为认定的主要标准较为不妥,进而分析目前虐待罪被冷置的主要原因,并提出精神虐待和婚内强制发生性关系是虐待刑法规制亟待解决的两个问题。第二部分通过对精神虐待刑法规制不力的分析,提出在重新认识虐待罪的基础之上如何认定精神虐待构成虐待罪,以及疑难问题的具体解决方案。第三部分通过对婚内强制发生性关系的社会危害性及行为构成的分析,指出这一行为应当被认定为构成虐待罪,并辩驳了目前一种较有影响的主张——将婚内强制发生性关系认定为构成强奸罪。关键词:虐待精神虐待婚内强制发生性关系刑法规制 Abstract InChina’Scriminallaw,crime ofill-treatment is one oftheimportant rulesforthe regulation ofviolence within family tosome ofthe traditional ideas, abuse withinfamily members isoften regarded as afamily quarrel,which israrely regulated by witllthedeepening study ofdomesticviolence at home and abroad,the demand oflegalregulation(including criminallaw)of domestic violence tothejudicial interpretation oftheSupreme People's Court,persistent,recurrent domestic violence constitutes abuse of afamilymember.
